In order to comply with the FAIR CREDIT REPORTING ACT employers must certify to us that they are requesting these reports for employment purposes, will maintain certain records and comply with all employment laws.

Remember, some states have both statutes and agency guidelines; others have only one source of rules, and a handful are silent on the subject.

Rights of employees and applicants:
No one can be denied employment because of refusing to answer a pre-employment inquiry that is unlawful under the Maine Human Rights Act or Maine Human Rights Commission Rules.

A conviction is not an automatic bar to obtaining an occupational or professional license; only convictions that directly relate to the profession or occupation; that include dishonesty or false statements; that are subject to imprisonment for more than one year; or involve sexual misconduct on the part of a licensee may be considered.

Special situations:
Liquor retailers may not employ anyone convicted of selling liquor to minors or selling liquor without a license within the past two years (for a first offense), or within the past five years (for a second offense).

*It is important to run a County criminal records check since about 30 to 40 % of county criminal records are not contained in the state criminal records and to insure the information is the most current available.

*County criminal records checks requires a manual search of records and takes 12 to 36 hours.
