In order to comply with the FAIR CREDIT REPORTING ACT employers must certify to us that they are requesting these reports for employment purposes, will maintain certain records and comply with all employment laws.

State Laws concerning background checks:
Remember, some states have both statutes and agency guidelines; others have only one source of rules, and a handful are silent on the subject. Some State laws are more restrictive than Federal laws.

Rules for employers:
Before requesting information, employer must notify employee or applicant; when submitting request, must tell State Police Department when and how person was notified.
May not discriminate against an applicant or current employee on the basis of an expunged juvenile record unless there is a "bona fide occupational qualification."

Arrest records.
May request information about arrest records less than one year old that have not resulted in acquittal or have not been dismissed.

Convictions.
May request information about conviction records.

Rights of employees and applicants:
Before State Police Department releases any criminal record information, it must notify employee or applicant and provide a copy of all information that will be sent to employer.

Notice must include protections under federal civil rights law and the procedure for challenging information in the record. Record may not be released until 14 days after notice is sent.

*National criminal records checks contains records from 38 states. it also includes registered sex offenders in those states.

*It is always important to run a County criminal records check since about 30 to 40 % of county criminal records are not contained in the state criminal records and to insure the information is the most current available.

*County criminal records check require a manual search of records and take 12 to 36 hours.

*Background check Release/Authorizations signed by applicants must be separate from employment applications and are subject to FCRA audit.

Please keep them on file for a period of two years in case you are asked to produce them.
